Section 1 of the Sherman Act prohibits agreements that unreasonably restrain trade. In United States v. RealPage (2024), the DOJ alleged that competing residential property managers violated Section 1 by feeding confidential lease pricing data into RealPage's algorithmic revenue management software, which returned coordinated dynamic rental price recommendations.
